Saw leaked pictures of the shorts a week or two ago which led to speculation that was going to be the style of the new alternate uniforms. I actually really liked the shorts, and still do, but I'm pretty meh on the tops. They're alright, but not great. They may grow on me once I see them in non-video game form.

Now, how do I get them on 2K13? Are they going to automatically be on there with the next patch or is it going to be DLC I have to pay for?

I think so, it wouldn't be the first time 2K accidentally leaked new jerseys. They leaked the raptors ugly ass camo jerseys and some other ones last year.
