He is at most guilty of voluntary manslaughter, I could also see involuntary manslaughter but there is no where enough evidence that he committed second degree murder.

The physical evidence was consistent with his account which made his self defense claim plausible, and given that guilt most be proven beyond a reasonable doubt not guilty was the correct verdict.

Scott says he acted in self defense when he confronted Cervini and two others saying they were stealing from neighbors cars. He told them he had a gun and ordered them to freeze and wait for police.

Scott says he shot Cervini twice when the victim charged toward him yelling he was going to get Scott.
