View Full Version : The Government is trying to take my sister's home

My sister and her husband own a house on 24 wooded acres that sits next to the county airport. The FAA approached them several months ago wanting to clear a bunch of their land for what they called safety concerns, but now they're talking expansion and imminent domain. They're meeting with lawyers this morning. The really bad thing is, they bought it before 2007, so the market value now may be less than what they owe on it, which means not only will it not be paid off, but they will have zero money for a new house.

Pretty much this. Really shitty position to be in. The right thing to do would be for the government to give them $ commensurate with the value of the house when they originally purchased it but that's probably not going to happen.

Pretty much the only people who beat eminent domain are incredibly wealthy and well-connected.

Its an unfortunate situation to be sure. But its unavoidable. When a million people want better airline service and youre in the way, youre not gonna have a choice but to pack up. Of course, the same people who get up in arms over it are usually the same people who want the government to usurp 25-40% or more of others' yearly income, starting at whatever arbitrary level is just above whatever they make. Not saying the OP, but a lot of the general hypocrite complainers.
Anyway, thats another story. Hope it works out ok for your sis, and when u get a chance post up some nudes of her.

Ehh, people typically buy properties as an investment and in general values go up over time. A downturn in the market is unfortunate but if the government paid original value instead of current value youd have a lot more pissed off people overall.
Nothing is perfect. Sometimes things just suck.

IMO they should give market value and if that isn't enough to pay off the loan then they should go ahead and cover that too...
so worse case scenario, just broke even on the house, lost what you put in, but not in debt...
so many cases out there of people who bought homes that have lost extreme value, and then lost the house for whatever reason and are now IN DEBT still trying to pay off a home they don't even have. Florida was really really bad.
Texas home values actually maintained throughout the recession thank god...

i find it hard to believe they're not going to compensate her extremely well for it. Its one thing if you don't want to sell and they force you out but if she is willing to sell pretty much everyone gets extremely well compensated for it when the government is buying. the governmnet overpays for everything.
I am real skeptical they're only going to give her less than what she owes on it.

Eminent Domain calls for "just compensation"... She won't lose a penny on it if she has a solid attorney representing her in the proceedings they could actually come out ahead since you say the property has been devalued... this could be a godsend for her...
95% of the time the courts side with the property owners in proceedings unless the owner is being unrealistic

Government is different today. They will hook you up. It is not as bad as people think. Most of ISH don't even know how imminent domain works.

You get full appraisal value which is more than you would get if you sold it privately.

That's not always true. Having dealt with city politics. For tax purposes they will say it's appraised at $250,000, for imminent domain sales meh we'll give you 150,000. That's what the last house in the neighborhood sold for :confusedshrug:

Hey man as has been said earlier when the government decides they want to take your property via imminent domain there is very little a homeowner can do.
However there are a couple of things I'd recommend your sister do. First off she should attempt to refi with her mortgage servicer (especially HARP if she has a loan backed by Fannie or Freddie; or a Streamlined Refi if she has a FHA loan) and if that isn't an option she should then apply for a HAMP modification. Both of these won't help her keep her home; but if the value of their property has decreased substantially some of that principal balance can be forgiven.
