You can't really fine someone if there is a reasonable chance it wasn't a flop. It has to be 100% obvious otherwise Harden would be fined on every drive.

Knowing James' history, it looked like he got hit, absorbed the blow naturally, then launched into a second act where it appeared as if he was about to commit himself to bellyflopping onto the court before deciding it'd be better to brace himself at the last second.

During real time, it just looked like he'd decided to let his body go limp for a moment, as if to induce a grander looking fall, of which he's done at certain other points of his career. That could have not at all been the case, but I feel the possibility is there. Surely though, the uncertainty yields an un-fine-able situation.
