What he's doing isn't victim blaming. What he's speaking about is the basis of reasonable doubt in a case like this. Belive it or not... When you're the defendant you're still presumed to be innocent in a matter like this, and the prosecution has the burden of proof, so any flakes in the argument the prosecution is trying to make should be brought to light. If the actions surrounding the alleged incident contradict the story, then it's fair game.

Naturally both the accuser and the defense can't both be presumed to be Innocent, so the natural line of thinking is that one of them is lying. And I don't feel comfortable automatically making that out to be the less sympathetic of the two.
