The "after three seconds" is the key here.

Since the top guy can see the other two he knows instantly that either:

Both of them are red, so he's white, so he'd say the answer right away.
Both of them are white, so he's red, so he'd say the answer right away.
Both are different, so he could be either red or white, so he won't say anything.

So now the second guy in line knows both are different. So since he can see the guy in front of him (either red or white), he knows his must be the opposite. So, after a slight delay, he knows for a fact his hat color based on the top guy's silence.
