OMAHA, Neb. —The family of the 32-year-old man who was fatally shot after a suspected armed robbery said despite his decision to rob the restaurant, neither man should have died in a gunfight.

Omaha police said Cortez Washington served time in Missouri after being convicted as an accessory to robbery and other felony charges. Cortez Washington was in Omaha finishing parole from the Missouri conviction. He was set to stay on parole until 2017.

He also had convictions in Kansas for eluding police, drug charges and property damage.

On Tuesday, police said Cortez Washington used an Airsoft pistol to hold up a Wendy’s, but the decision ended in a fatal officer-involved shooting that killed Washington and an audio supervisor filming for the television series, “Cops.”

“We all are victims in this,” said Tawanna Washington, Cortez Washington’s sister-in-law. “My condolences go to the 'Cops' TV employee and his family, but we all are victims in this.”

Tawanna Washington pushed back against the image of a repeat criminal. She spoke about how Cortez Washington was the father of six, a husband and family man. She said he should not have died.

“We’re not coping at all because I totally feel like their account for what happened is totally bogus,” she said.

She said the Airsoft gun her brother-in-law carried Tuesday night is a toy.

“And even when you pull it back, you hear how it pulls back, he said when you pull it back it sounded like a real gun? And Cortez fired the gun at them? Does that sound like a real gun to you?” she said.
