recently set up an account at pokerstars, and this question popped into my mind. if you are an amazing poker player, or actually just any good poker player that has a long term winning percentage of over 50%, then is it still considered gambling? I mean think of the stock market, where people put money in as well, and where 90% of the people lose and 10% become rich. gambling has its trends, and those that are smart enough to grasp probablity, or are very good at reading other people, is that still considered gambling for them? or just an occupation that plays a game based on money?

poker is a skill based game but by definition if you are playing for money then yes, you are "gambling"

gambling laws vary from state to state but usually the skill based games are shown leniency over games of pure luck - craps, blackjack, etc.

the reason that Fanduel and Draft Kings are legal is because they are considered "skill based"

and...Fantasy Sports IS skill, exactly like poker, the more knowledgeable players have an edge on those who know little...and in the long run that edge will always equate to profits, just like a casino.

it's still "gambling" though

But why is betting on players different than betting on teams in the eyes of the law?

Most poker players that live off poker don't consider themselves gamblers. Gambling is risking money by leaving your odds of winning up to fate. Poker players make pretty steady hourly rates that average out over time. For example a solid poker player will make 35-50/hr at a live 2/5 game, around 80/hr at a 5/10. Once the variance evens out, his skill will make him win 7-10big blinds per hour over weaker grinders and recreational players.
