I believed he gave himself away when he said he thought she was 17 and there was nothing wrong since they were only 2 years in age difference. 17 years of age is still a minor and how he nonchalantly said it was 'only 2 age difference' probably pissed off the judge.

Now if she was to lie and said she was 18 and he engaged in sex with her thinking she was of age then I don't think the judge would have thrown the book at him.

He plead guilty, probably with the hope of a lighter sentence. He spent 90 days in jail and he probably risked a much longer jail sentence had he gone to trial.

Under law, the judge could have chosen a lighter sentence that would not have put him on the offender list and would have let the record be expunged after he completed probation, but he did not. The plea bargain was that the prosecutor was to be "neutral" as to the sentence. However when sentence came up he reminded the judge that the judge have put similar offenders on the list. That's going to form the basis of an appeal.

Anyways, all websites you must be 18 years of age to sign up on the adult section regardless of other state rules. Sites choose 18 years of age just to be on the safe side.

In most states it's either 16 or 17 (38 states). It's just that California has their stuff set at 18, so people think you cant have sen with someone under 18 if you've over 18--Hollywood effect. It helps that you have to be at least 18 to be in porn, though. Even in Europe it's mostly 15 and 16.
