If you keep semi-nude photos of your GF from HS you can be arrested for child porn

I heard on that on the radio today when they were talking about the Subway guy who they expect to plead guilty to child porn charges this week.

I'm ok with our current age of consent, vigorous prosecution of adults having sex with minors as long as they are more than 3 years in age apart, and the sex offender registry. But I never even thought about old photos from high school of topless girlfriends. I bet there are a lot of guys out there who haven't even thought of this.

What's your opinion? If a guy has kept topless photos of his girlfriend from high school and he can prove he was a minor and in a relationship with that girl at the time he took them, do you think he should be hit with child porn charges if he doesn't delete them the second he turns 18?
