I run a painting business, had a contract to paint over 20 townhomes.
The president of the Board who lives in the neighborhood turned out to be a prick, accused me of braking a glass window and of doing a sloppy job on one house so in order to make him happy I fired the old painters and hired new ones.

He becomes very good friends with the new painters and they are doing an excellent job, until out of nowhere I receive a letter saying due to bad painting services the contract is terminated.

Everything is fine here, until today I go to get some ladders at the townhomes and there are the employees who used to work for me, the prick hired them. In my opinion this makes his written notice invalid because if the painting was so bad why would he hire these same painters?

I feel it is discrimination. Lost $20,000 contract.

You certainly have a case, but dont use the word discrimination and be warned lawyer fees might eat up the money you would have earned for the job.

I don't ask for handouts if you felt someone did you wrong you would do the same thing especially if you run a business

It just seems like he thought your work was shotty so he didn't want to do business with you any longer. And you can't accept the idea of you doing sub-par work so your trying to find someone else to blame aka sue. "He doesn't like my work? He must be racist!"

Depending on your contract you may have a case. Idk what was in your contract, but most contracts state that the work needs to be up to standard or the contract can be terminated at any time.

It actually doesn't seem like this at all. If he didn't like the work, why would he use the same workers?

It's more likely that he saw a way to cut his costs and chose to violate his contract to do so.

If you have evidence of him saying the new workers were excellent, you will have a stronger case for him violating the terms of contract. I would not use the word discrimination in any way shape or form.

A Lesson Learned might be to write your contracts in a stronger way. You may want to look up what others in your industry do.

Another Lesson Learned might be that don't let the customer get close to your workers if it can be avoided.

Why can't I use the word discrimination ???
Not saying you didnt go through any but because you didnt mention any in your story. And when people hear the word discrimination they stop listening. :confusedshrug:

the problem u have is u fired the old crew therefore acknowledging you/they fukked up.

what u have going for u is u can likely show collusion between him and your new employee's to conspire to break the contract on disingenuous terms.

i'd talk to a lawyer and at the least file a suit against him just to get some payback.

then i'd hire some goons to vandalize everything the new painters did :coleman:

Why can't I use the word discrimination ???
Because your story contains no evidence of it.

Is there a discrimination aspect to the story?

It sounds simply like a straight up violation of contract.

Let me put it this way, if everyone involved was Korean would any discrimination be involved? Would a wrong still be involved? What's the nature of that wrong?

Are your workers Mexicans?

so you're saying he hired someone without any written contract being signed by his new employee?

Damn, he did you dirty. Probably is paying them half. No, he's probably paying the workers a little more, but paying less overall by cutting out the hiring manager's pay.

It sounds like he used OP to recruit a bunch of good workers and then got rid of OP.

I have an instagram page where I put pictures of all my work, I didnt even know this guy had access to my instagram but out of nowhere he tells me take all the pictures down on instagram, but by the way he said it i sensed jealously, hatred, this guy was yelling down my throat like I had killed somebody. It was verbal abuse.
This guy accused me of breaking a window, said he doesn't understand how I'm a business owner about 50 times.

I suspect we're not hearing the whole story here.

I had a contract to paint townhomes.

One job was sloppy i fired painters because of that and hired new painters.

President of the board didn't like me regardless and terminated the contract on a written note saying painting service was bad.

He then went on and hired those same painters.
