Under the new law, which goes into effect Jan. 1, a restraining order could be issued without prior knowledge of the person, KPCC reported. Therefore, a judge could technically issue the order without ever hearing from the person in question.

California can claim it's the law all they want. The fact is, that it isn't. Any law that is in violation of the United States constitution, isn't a valid law. It just doesn't count. People have a right to due process and a right to be secure in their person and property from unreasonable search or seizure. Pretending that they have legal authority to do this is no different then pretending they have the authority to legalize slavery or outlaw journalism.

Let's not confuse who the cowards are. You're not against guns because you're so tough that you don't need them to feel safe. You're against guns because you're terrified about other people having them.

California does have a lot of gun laws due to the sheer amount of legislation thrown around in the state but it's constantly getting slapped back at them by the courts. I doubt this will stick.
