i'm trying to think of what his excuse might actually be...

"see, i just have a different form of balance than most players. i need to move my legs around to make the kind of moves i make and to land on my feet properly. they can't penalise me just for keeping my balance!"

Most of these moves have his leg swinging in a natural motion. Yesterday he kicked his leg up after the shot way up higher than in most of these clips.

i'm not sure i see the point in flailing.

a classic flop is a lot easier to sell (and makes more sense) than just kicking your limbs around.

flailing is eventually going to get someone (or yourself) hurt one day. overall it's intentional and should therefore be cracked down on IMO.
