i do agree that public justice often doesn't seem to consider all the consequences and ramifications. In his case, those are five pretty f-cking huge negative consequences that he's going to have to live with for life.

I think a 2 year sentence, which means he would probably actually serve 1 year, makes more sense. Ironically, a more appropriate sentence actually would have made his life easier moving forward. Now, since he's only going to serve 3 months, people will forever treat him as the kid who got away with rape. I think the judge actually did him a disservice with the lenient sentencing.

The only way to prevent things like this from happening is to not drink at parties. I think that's the most F'd up part of the story and why it originally became big news. If the judge had just sentenced him light and said the crime wasn't as severe as others then it's just another case. But the judge made it out like the sentence was less about any details on the crime and more about how he feels toward the defendant. Judge is the one who made a mess out of this.

He was rightfully convicted of attempted rape. There is no doubt that engaging in sexual activities with an unconscious person is unacceptable and criminal, even if it was your girlfriend/wife.
That said, I'm arguing about how much guilt he was able to contract by his actions. At (frat) parties in college, kissing/sex is an expected and at times even intended result of social interaction. It is plausible that Brock was assuming consent in this case (somewhat influenced by "rape culture", if you will)
It is also plausible that the woman would have regretted her Actions even if she had not passed out and not engaged in sexual activities with the guy. She was too drunk to consider her actions at the time and unable to give OR refuse consent.
