View Full Version : Got caught going +30mph....suggestions?

I don't know what I was thinking. I only have 1 speeding ticket in my history which happened 2 years ago and was issued a $256 fine. Tonight, I was going out and thought I saw one of my cousins up the road so I tried speeding up to get to him. Not only was it not my cousin, but on the down slope of the bridge there was a cop sitting and caught me with a pro laser iii. He pulled me over and asked me if I knew why I was stopped, I told him I may have been driving a little bit over the speed limit (I 'guessed' 65) to which he scoffed and he claimed I was going about 40 over 55.

At this point I told him I didn't think I was going that fast and apologized, but it was of no use. He went back to his car and came back about 10 minutes later with a citation that didn't have a fine or anything, but he told me I have a mandatory court date I have to attend about 1 month from now and if I failed to show up, I would have my license suspended and they would issue a warrant for my arrest. Now I of course plan on going to this court date, and I'm obviously gonna get real life legal advice before I decide on anything, but I wanted to hear if you guys have any advice for me (other than to slow down..lol).

I'm hoping the officer doesn't show up to court, but in the case that he does should I be represented by a lawyer or should I plead guilty considering he used a laser and he was stationary? Because I haven't been pulled over in over a year, will I be able to take driving school to get rid of the potential 4 points? I'm not excited about paying fines and fees (would run me up to around 1k most likely...I can afford it but I'd rather have it reduced of course), anyone been in this kind of situation before? If any Floridians, I need your input, but I am also interested in other states how it went for you guys.

I was stressed all night ever since it happened and just got home, cooled down considerably. I know I'm an idiot for getting myself in this situation, but I need all the advice I can get. I've talked with friends already but have yet to tell my dad (will tell him tomorrow, can't hide this...).

Wow, only one? I had over 8 speeding tickets my whole life, and got away with only of those.

Firstly, relax. It's not like you got a DUI.

If you go 30+ mph a court the Traffic School option is NOT automatically available i.e. you are not deemed guilty and receive no points/auto insurance would not go up.

At the court appearance it will be determined if an infraction occurred i.e. did you speed? An officer can appear or provide his notes.

Your looking at a civil penalty/fine up to $500and/or traffic school, in addition and your auto insurance may go up but that is up to their discretion.

If I had to guess and if it's your first offence i would give you a small fine and traffic school. Be prepared for both but hopefully they give you the option. Wear a tie.

The insurance is what I'm really worried about...I think I found a pretty good lawyer, gonna talk to my dad tomorrow and hopefully call this guy. He has great reviews, over 190 reviews on this site alone: https://www.avvo.com/attorneys/33762-fl-david-gilbert-3339550/reviews.html?page=5
