Hi guys, Monta Ellis MVP checking in here. Many of you know I am a huge Pacer fan and I was actually in the same section as that fan last night. People around us were pretty upset but after the game PG came and apologized and gave out some Pacers gear.

did he even hit that girl's face? watched the vid multiple times and it appears to me that the ball hits more her shoulder or something (just saying, getting a chest pass for example straight in your face hurts pretty much, these balls are heavy).

Wondering if the fan files a lawsuit to get 5 Billion Dollar from the Pacers franchise.

The team has no liability. On the back of your ticket there is a disclaimer that objects can come into the stands and potentially injure you and that you need to always be aware.

See how enforceable that "disclaimer" will be. Is someone asked to read it before purchasing a ticket? Reasonable expectation for safety is a given. The team may not be sued, but PG can be.

She has no personal injury claim unless she actually sustained some sort of injury, which is unlikely.

On a side note, such exculpatory clauses like that are generally unenforceable (at least in NY) unless they find "gross negligence" but ehhhh, I'd have my share of reluctance before taking such a case.

I like PG and I'm not going to hold it against him beyond this quick moment, but that apology looked half assed. His teammate ushered him there and he did a quick hug and walked away. Take a moment and sincerely apologize.

That disclaimer won't protect the Pacers from shit, especially since the ball was intentionally kicked.

Those disclaimers don't mean shit. They can still be sued if negligence or intent is proven.


The stadium owner still has an obligation to act reasonably to minimize the risk of injury to spectators. That is why all baseball stadiums have netting behind home plate to protect against foul balls. The netting is behind home plate because balls that are fouled straight back are going so fast, and the spectators are so close, that a spectator could not reasonably get out of the way. However, although home run balls also leave the field of play, there is no netting in the outfield because the balls are not traveling as fast and because the spectators in the outfield seats have had four or five seconds to track the ball traveling toward them.

If you get hit by a foul ball while sitting between home plate and first base, you might be able to make an argument that the netting was not large enough, depending on exactly where you were sitting. The stadium industry has standards for how far away from home plate the netting should extend. If the stadium that you were injured at did not meet those standards, you may have a legal case against the stadium owner.

Another example where the disclaimer might not hold up is if you were sitting behind home plate and a foul ball went through a hole in the netting. In this situation, you could argue that the stadium owner was negligent in its upkeep of the netting.

Regardless of whether or not the team is absolved from liability due to the waiver/disclaimer on the ticket (and warriorfan is right, generally these do hold up), the victim is going to have to prove damages as part of any liability claim she files. Unless she went to the hospital/doctor and thereby incurred provable economic damages, she's going to have a tough time encumbering the team's (or, more likely, the arena's) insurance carrier to pay out on a claim. What is she going to claim? Mental anguish? Loss of quality of life because now she's afraid to go to basketball games?

Even if she did go to the hospital/doctor, and even if the team's insurance company feels the need to reimburse her, they're likely simply to pay a subrogation claim from her health insurance (who would likely have paid the bill), presuming she has it, and perhaps a small kickback to her for her pain and suffering (think a couple hundred bucks)

Insurance companies aren't in the business of handing out piles of money just because. The only people that get mad cash from liability settlements are people who are horribly injured. Taking a basketball to the face at a slow rate of speed doesn't get you life changing money.
