"The Iowa Appeals Court has ruled against a convicted killer who says he "died" during a medical emergency and thus fulfilled his life sentence.

Wapello County court records say Benjamin Schreiber has been serving the life term since being convicted in 1997 of beating a man to death.

Schreiber says his heart stopped five times on March 30, 2015, at a hospital where he'd been taken from the Iowa State Penitentiary in Fort Madison.

Schreiber filed for release in April 2018.

A district judge found little merit in Schreiber's argument, saying his filing confirmed he was still among the living.

The appeals court affirmed that ruling Wednesday, saying: "Schreiber is either alive, in which case he must remain in prison, or he is dead, in which case this appeal is moot."

Did you even read your link?

It's not his second life, it's still his first. He wasn't born again. He just came back to life. Also only a doctor can pronounce death. I doubt he was pronounced dead, else CPR would've been stopped.

You didn't even read your whole reference. Or if you did you didn't comprehend it.

Either way, I'm not debating with you on this. He's still on his same life. :lol He deserves to stay in prison all his life until he fully dies indefinitely.

This is correct. You can still be alive with your heart not beating. You have minutes infact of brain function, etc. He was probably never pronounced dead as it said his heart stopped five times. So they probably had issues with keeping his heart from shutting down. Obviously they overcame that because his stupid ass is still alive arguing he should be released.

I have a heart murmur. Sometimes my heart skips a beat. Does that mean I died and came back to life!? :oldlol:

Unless the ruling is a double life sentence, then the loophole applies. You charge someone with a double life sentence to defeat the purpose of parole getting you back out, or if someone is pronounced dead and comes back to life.

So the question is was he pronounced dead by the doctor or not. If he was, then he came back to life, he's technically on his 2nd life. If not convicted for more than one life sentence, he should be a free man. :lol

The link doesn't state that.

As said if he was pronounced dead CPR would've been stopped.

Also does he have a second birth certificate? Else it's the same life.
