Legal advice: non-contract subletter can't pay rent and refusing to leave

So I live in this 3-bedroom apartment in Brooklyn (have for the last 5 years) with myself and my other close friend the only ones on the lease. We brought in a subletter about 3 months ago and didn't do the proper due diligence (mainly b/c another friend of ours who was originally staying there moved out quickly and we didn't have much time). The subletter is a very awkward mid thirties guy from trinidad who barely says a word for reference.

Towards the middle-end of August, he just says he can no longer pay rent and starts saying he won't be bullied and that he has the right to stay. Because he's lived here for over 30 days it gives him tenant rights even though he's not on the lease. I was pretty heated and I said I would bring some friends over and have him removed physically. He then calls the cops and says I threatened him with violence lol. The cops do nothing, say this needs to be resolved with the landlord (which technically I am this guy's landlord b/c he's not the on lease). That next day my friend who's on the lease put together a notice of termination and had his gf serve it to the guy. It gives him 30 day notice before we can officially evict. The next day we also changed the wifi password.

Now it's a week later, and this motherf*cker is in no rush to go anywhere. Literally won't leave the apartment, just sits in his room with no wifi or comes out into the kitchen and cooks like everything is fine. It's insane.

How in the hell can I legally get this guy the f*ck out of my house as quickly as possible? We considered changing the locks, but we know there could be legal ramifications that could allow him to stay longer if we did. I feel like he is literally gonna just squat for the 30 days and plus however long the eviction process is. There has to be a way to get him out of here faster.

Any advice would be GREATLY appreciated.

Apparently, that can lead to a judge granting him a longer stay if he pursues it through the court b/c it's an "unlawful eviction" or something.

Plus this mother****er WON'T leave the apartment.

Hopefully having him there in the first place is against the terms of your lease and you get kicked out over a **** load of drama that unfolds. Unfortunately I’m guessing that won’t happen if NYC is desperate for renters. It was also stupid af to give him a letter with your name on it saying that he lived there, hahaha.

Honestly, best way to do it unethically is to file a restraining order. He will have to leave the residence and you'd setup a court day but it's the legal loophole way to evict a non-payer

Not being able to kick him out doesn’t mean it has to be comfortable. How much does he use that you could remove? Is the bed his? Take his bedroom door down. Take down curtains if he sleeps during the day. If you have the Easy clean windows with the golf in panes you can remove....take the ****ing window panes out. How long would he stay with no climate control?

Find the legal limits of comfort you must provide. I suspect you have to provide water but that may be it. He does have some ****ed up rights I’m sure.
