View Full Version : Texas state sues states Michigan, Wisconsin, Pennsylvania and Georgia

For unlawful election results. Think about that. Texas is saying that the results for those 4 states should be deemed unconstitutional by the US Supreme Court :oldlol:
-Texas Republican Attorney General Ken Paxton on Tuesday filed a lawsuit in the U.S. Supreme Court to invalidate presidential election results in Pennsylvania, Georgia, Wisconsin and Michigan.
-The lawsuit asserts that "unlawful election results" in those four states, which President-elect Joe Biden won, should be declared unconstitutional.
-The filing argues that those states used the coronavirus pandemic as an excuse to unlawfully change their election rules.
-Experts in election law were quick to dismiss the likelihood of the nine Supreme Court justices taking the case.https://www.cnbc.com/amp/2020/12/08/texas-sues-four-battleground-states-in-supreme-court-over-unlawful-election-results.html
They also want the US Supreme Court to push back the Electoral College vote from December 14th until such time as the election investigations across the country are finished.
US Supreme Court will not take the case most likely, but such a case is unprecedented and insane.
That's kind of how Hitler took power. He asked for temporary powers to investigate the German Reichstag fire (which he had orchestrated). German Courts/their congress equivalent granted Hitler temporary power which he then used to stop all future elections as soon as the temporary power was granted by their courts, and he ended democracy over night. I wonder if Trump or one of his minions like Rudy reached out to Texas to do this lawsuit

Good. There is no way that 15 million more people voted Joe Biden than voted for Barack Obama. There is no way that Joe Biden is more popular than Donald Trump.

Just one sentence ruling from the US Supreme Court, which is pretty much unheard of coming from the US Supreme Court.
“The application for injunctive relief presented to Justice Alito and by him referred to the Court is denied,” the order said.
That's it. One sentence. No explanation, no dissent, nothing else but that single sentence from heavy-Republican US Supreme Court
That tells you lil Donny has no case. Checks-and-balances wins again.

Only denied emergency injunctive relief. In other words, they did not dismiss the case, they denied the request for a court order overturning PA election before hearing the case. The case is still pending.
PS - Aaaand just like clockwork, the Texas case is announced, and the Dems have their useful idiots setting up another autonomous zone, this time in Portland. Same old playbook. To distract from what's going on.
PPS - I love Texas. I hope BLM and Antifa are dumb enough to riot there. I could use a few laughs.

The suit RMWG posted about is not the same as the one in the OP. You know why the judge gave an injunctive relief on that suit? Because another one has been docketed which covers the same, the one from the OP - which Louisiana is joining.

It's not about fraud, it's about Texas kowtowing to Trump and taking issue with those state's mail in ballots. First, Texas nor any other states don't have a say in how other states conduct their elections so they can sue all they want, it's all for show, it ain't going anywhere. It's Trumptard POS state government officials suing other states to appease the côcksucker in the White House who for sure is strong arming these officials to sue knowing it isn't going anywhere.

PA Governor changed election rules and PA SCOTUS ruled it into law. But per the constitution, no court of law makes election rules, that is up to the the state legislatures. Texas is saying that because a bunch of ballots has been counted in violation of the constitution, it has deluded the vote of the people in Texas and all other US citizens.
Non-legislative actors’ purported amendments to
States’ duly enacted election laws, in violation of
the Electors Clause’s vesting State legislatures
with plenary authority regarding the
appointment of presidential electors.
• Intrastate differences in the treatment of voters,
with more favorable allotted to voters – whether
lawful or unlawful – in areas administered by
local government under Democrat control and
with populations with higher ratios of Democrat
voters than other areas of Defendant States.
• The appearance of voting irregularities in the
Defendant States that would be consistent with
the unconstitutional relaxation of ballot-integrity
protections in those States’ election laws.

I don't even understand their case. Each state has the right to run their election how they want.
States like California, new york, new jersey, georgia, wisconsin, michigan, pennsylvania should do a counter-suit arguing other states don't have the right to impede on state's rights to legislate election laws in their state. That would be on solid ground of the state's rights that the US Supreme Court can't usurp & it would derail the Texas lawsuit.

It's sad you think this way about potential corruption. This report was made out of information from a laptop which the FBI sat on for a year, no one has investigated if and how Joe is connected.
You know where I stand on it, I find it too hard to believe that Joe's foreign policy quests fail every time it favors the country of which his son is doing business.

I knew what the lawsuit was for (-The lawsuit asserts that "unlawful election results" in those four states, which President-elect Joe Biden won, should be declared unconstitutional. -The filing argues that those states used the coronavirus pandemic as an excuse to unlawfully change their election rules. From OP.).
What I can't make sense of is their justification. Each state has a right to run their election how they want. The legislatures from those 4 states did not have any issue with expanded mail-in-ballots so what credible justification does TEXAS state have for that lawsuit? Those individual states can run their own elections however the hell they want thanks to states' rights. What right does TEXAS state have to dictate how Michigan state runs their election? There is no argument there thanks to states' rights.
Unless if you can prove both that 'H' is in fact 'Hunter Biden' and 'big guy' is 'Joe Biden', it doesn't matter. I think it could be. Unfortunately, 'could be', 'may be', or 'might be' isn't an argument in a court of law.

They have every reason to challenge. If states didn't follow the constitution in their election process and allow fraudulent votes to count it diminishes the valid votes of those states that ran clean elections. Why should half the country have to live a certain way due to a few corrupt states?

Scotus will decide what's what.
Side note - I wouldn't be surprised if Rudy Guliani and Jenna Ellis dont really have covid. The timing is funny. This looks like some heavy duty trolling by Trump and co. :oldlol:

Good. There is no way that 15 million more people voted Joe Biden than voted for Barack Obama. There is no way that Joe Biden is more popular than Donald Trump.
Trump is more hated than Obama was liked. Not hard to believe. Everybody and their dog knew this election was going to have a legendary turnout.

This is Ken Paxton angling for a pardon because he's in the shit up to his eyeballs right now.
This.
The story exploded into public view last month when seven top aides to Paxton accused him of participating in bribery, improper use of his office and more. Reporting from The Dallas Morning News, investigative government reporter Lauren McGaughy filled in the picture for Texas Standard, saying the allegations against Paxton related to his actions purportedly taken on behalf of a donor, Austin real estate developer Nate Paul. While Paul was in the midst of several bankruptcy proceedings, Paxton took the unusual step of hiring an outside attorney to investigate counterclaims Paul made in relation to the case, and appeared to offer additional legal assistance.
“They had some very serious concerns about it,” McGaughy told the Standard. “They were so concerned that they told law enforcement.”

It’s never been harder to tell who is trolling and who is stupid. I know republicans personally who troll the fraud nonsense on Facebook but in a real conversation it’s just jokes and they know he just lost. I feel like some of that must be going on here because it’s hard to believe you let Trump fool you this completely.
I feel like the level of idiocy to not see what’s happening would have been more evident in some of you than it has been till now.
The people supporting this are literally....stupid. It’s just stupid people. And it’s sad to see how many people are THIS stupid. I just can’t accept that most of you are serious and I just couldn’t see how stupid you had been previously.
Theres no way Trump himself is this stupid. Talking about how he was winning at 10Pm as if his team of professional campaigns managers didn’t know and communicate to him in advance the time windows on mail in ballot counting. You know they knew which states count them last by law and established procedure. No way they just....didn’t tell him. But he goes on tv and pretends he was about to throw a party with like 40% of results having been counted.
People like me and people waaaaay more informed on electoral issues were saying he would appear to win big just off republicans having a huge edge in day of voting.....then mail in ballots would narrow it. You think I figure that out off google but the chairman of a national campaign doesn’t? He knew a week early he’d be up election night win or lose. They talked about “election week” in advance but he’s fooled you into thinking....he thought....it was supposed to be over at the close of west coast polls?
You have to know he’s not that stupid. You have to. You can’t all be this gullible....and I hate I don’t know you in person to confirm that and put my mind at ease.
If this many republicans are truly this stupid my faith in this countries future is seriously shaken. I’m hoping a lot of it is like that Pennsylvania politician who said they have to pretend it’s legit because their house would get bombed if they didn’t. Just....pleasing the mob to keep the peace.
I genuinely hope that’s the case. It’s bad there’s enough stupid people to have a mob to begin with but at least the mob would explain the behavior of a scared but rational majority.

I just realized if the electoral votes of Michigan, Wisconsin, Pennsylvania and Georgia are all thrown out...Biden is still winning 247 - 232
I guess I just assumed that it would have Trump the winner, but it doesn't
Ahh, but that's not their goal. Their goal is to make sure nobody hits 270 majority so then it goes to a House of Reps vote where every state gets 1 vote. There are more Republican states than Democrat so Trump wins in such a scenario.
That's not going to happen though. Not only do the votes have to be invalidated but in all 4 states. They are not even arguing voter fraud but rather "could have happened." That's not enough to win a Supreme Court case to toss out millions of votes

As far as I can tell it just says a candidate has to receive a 'majority' of the electoral votes. I can see where it comes down to the House in the event of a tie (269/269) and no one has 270. But I am not seeing that in the event that a candidate does in fact have a majority of the available electoral points.
I mean surely you're right and I just can't find the fine print here...

Majority is 270. If nobody hits 270, it goes to the House afaik. I don't think the majority of available electoral points is relevant. It's just been 270 since we have had 50 states.
I know what you are saying though. Unfortunately, if they excluded 4 states from consideration in electoral college, there better be a damn good argument to do so. Supreme Court is not going to mess with states' rights without a damn good reason that cannot be questioned as per US Constitution. It can't be "could have mass fraud" but got to "has mass fraud"

Republicans clearly now think that they can bully the Supreme Court into overturning an election. Much of the support that Trump and Texas are getting for this lawsuit is nothing but a show to appeal to Trump voters, but as Pennsylvania wrote in their response to the Supreme Court, the lawsuit itself is a seditious act.
Read each one of those 106 House names, and understand that not since the Civil War has America faced a more grave domestic threat than the autocrats who are lining up to destroy democracy for Trump.

I can see that it has gone to the House because no one had 'majority electoral votes' in 2 previous occasions...both in the 1800s, one where it was tie in electoral votes, the other is when there were 4 candidates and none of them had a 'majority'.
Currently 270 is the 'majority' of the available electors...what I am not seeing is that 270 is STILL the majority when electors are removed via lawsuit...because when you remove those states, 270 is no longer the 'majority'.
But you know...I'm sure youre right here otherwise none of this makes any sense at all

Of course the majority changes if you remove states from consideration.
But that opens a whole new pandora's box. That's why I was saying that excluding states from consideration in electoral college better have a damn good reason. It is equivalent to not allowing those 4 states to represent themselves in the federal union altogether and equivalent of saying those states have lost their standing within union. That's very dangerous. That can only happen if there is mass voter fraud in all 4 states & rest of the union has no choice but to go along with it. That, of course, requires indisputable evidence. No such evidence has been presented, and Supreme Court can't hear new evidence that hasn't already been provided to lower state courts & federal courts.

Even if they can present new evidence, they are still not claiming mass voter fraud so how exactly do they plan on getting millions of votes tossed out?? There has to be justification for that. "Could be mass voter fraud" =/= "Has been mass voter fraud"

They're not trying to prove that fraud occurred with the Texas lawsuit, only that the states in question violated the U.S. Constitution in their conduct of the presidential election (changing rules on the fly without going through the state legislatures) , rendering their elections invalid. That's the beauty of it. It circumvents the fraud issue (we can address that later. :D)

The suit argues that safeguards were removed and that poll observers were systemically removed from observation of the ballots at certain times:
Abolishing signature verification. First, the
proposed Bill of Complaint alleges that non-legislative
actors in Pennsylvania, Michigan, and Georgia
unilaterally abolished or weakened signature verification requirements for mailed ballots.
Excluding Bipartisan Observers.
The Bill of Complaint alleges that certain counties in
Defendant States excluded bipartisan observers from
the ballot-opening and ballot-counting processes. For
example, it alleges that election officials in
Philadelphia and Allegheny County, Pennsylvania,
violated state law by excluding Republican observers
from the opening, counting, and recording of absentee
ballots in those counties. Bill of Complaint, ¶ 49. And
it alleges that election officials in Wayne County,
Michigan violated state statutes by systematically
excluding poll watchers from the counting and
recording of absentee ballots
I don't care about his defense fund blade, Biden has one set up as well. I don't see you posting either about the local BLM chapters complaining that all the donation money have seemingly disappeared into the main organization.

This is the reality everyone should accept, right?
-Safeguards were in place and followed during the election, so there was no fraud.
-There has been no evidence show there was election fraud.
-Affidavits from poll observers are all either processes they are mistaken about, or the observers themselves are crazy "Qanon" types. Besides, affidavits aren't real evidence.
-Affidavits from postal workers saying there were ordered to backdate ballots after the election, they're from crazy "Qanon" types. Besides, affidavits aren't real evidence.
-The State Farm video from Atlanta doesn't show anything, and it doesn't matter that no observer or election official was in the room during the counting, the election was still safe.
-News reports of them stopping the count weren't real, it was just the cutters who were going home.
-Trump has no case and he isn't even arguing fraud in the lower court cases.
-Giuliani is helping out because he's seeking a pardon.
-All state elections have been certified, because there was no fraud.
-"Safe Harbor" has been reached, and from this date on no voter fraud can be proven, so really it doesn't matter even if there was fraud.
-Trump is in a conspiracy with the Texas AG to sue certain states on fake charges. The Texas AG is doing it because he's seeking a pardon of drug out charges from 2015 that he's not yet convicted of, recommending shares of a certain company without making it known that he was getting rewarded for referring a certain number of buyers.
-20 other states have either joined or is supporting the suit, some with counsel, they're doing it to kiss ass to Trump's base.
-SCOTUS lawsuit has no chance, so there's no point in talking about any of this.
-Trump is doing all of it to raise money to pay for campaign loans and run again in 2024.

If all the questionable states get thrown out, and no candidate has 270 votes, it turns into a "contingent election" - https://en.wikipedia.org/wiki/Contingent_election
Basically, the next POTUS would be chosen by a vote in the house of representatives... but instead of all 435 reps getting a vote, each of the 50 state delegations get 1 vote. There are currently 26 state delegations controlled by republicans, so they would be guaranteed to win the vote if they act in unison, which would probably mean another 4 years of Trump. That said, theres no rule that these state delegations have to vote someone from their own party, so in a contingent election Biden could still win if a couple of republican state delegations defect to him.
The vice president would be determined in the senate, and in this case all 100 senators would each get 1 vote. Currently the republicans have a 50-48 advantage in the senate, but the 2 undecided seats in Georgia could theoretically go to the dems making it a tie. I am a little confused about what happens if there is a tie here, typically if there is a tie in the senate the sitting vice president is the tie-breaking vote, but obviously Pence would have a bit of a conflict of interest in this particular situation.
In one of these contingent elections, the candidates can come from different parties if thats how the house/senate decide to vote... so we could theoretically end up with something like Trump/Kamala or Biden/Pence.

No it doesnt. Read the wikipedia article I linked, or read the 12th amendment, or just google "what happens if no candidate gets 270 votes"
A candidate doesnt need a "majority" of EC votes to win, they need an "absolute majority" - which means more than half of the total votes

"half of the total votes" is less than 270 when you remove 4 of the states.
Honestly I can't find anything that really details this specific situation...it's would be a first in history. That contingent vote has come up when 2 candidates tie the electoral vote...or when there are 3+ candidates and none of them has "majority". There is nothing written about what the majority is when you remove electors....but IMO it seems logical that assume that removing electors changes the majority number.

The total possible number of electoral votes is 538 (538/2=269, which is why it takes 270 to win). If a state gets disqualified their potential votes are not removed from the pool of total votes available, they are simply left unassigned.

I believe the electoral HAS voted, on the 9th (Safe Harbor Day)...on the 14th they just make the formal announcement of that vote
Thought the 9th was the certification deadline for all the states?

The Republican Party is full of mental illness.
It's been highly entertaining watching ISH Trumpanzees twist themselves into knots for the past month, trying to convince themselves that they can overturn this. What will they come up with next? :oldlol:

Now they will try to force the states to send alternate electors or go after the electors. That's the next desperate move to cause chaos in electoral college. I don't know what the electoral college safeguards are to protect that process from being pushed into chaos by lil Donny

trump is really making the most pathetic exit of any potus in history. absolutely pathetic and embarrassing.
He won't concede like the total sore loser whiney bitch ass mark he is...really could've gone out like every other one term POTUS with dignity and set himself up for another run in 4 years but no one outside his base will want to deal with his immaturity again.
He's done in presidential politics, enjoy Trump Network, Trumpys.

The 2 (Thomas and Alito) both said they would hear the case out but would have refused to overturn the election.

Now some House Dems are calling to unseat the members who backed the lawsuit pointing to the 14th Amendment which states that "no one who has engaged in insurrection or rebellion against the the US can hold civil or military duty".
Basically view the lawsuit as a direct attack to Democracy.

I didn't see that. That highlighted part might actually be treasonous but he intentionally kept it vague. Of course he would have to take steps towards it then it might be straight out high treason
