U.S. appeals court temporarily blocks Biden's student loan forgiveness plan

WASHINGTON, Oct 21 (Reuters) - A U.S. appeals court on Friday temporarily blocked President Joe Biden's plan to cancel billions of dollars in college student debt, one day after a judge dismissed a Republican-led lawsuit by six states challenging the loan-forgiveness program.

The 8th U.S. Circuit Court of Appeals granted an emergency stay barring the discharge of any student debt under the program until the court rules on the states' request for a longer-term injunction while Thursday's decision against them is appealed.

The St. Louis-based appeals court also ordered an expedited briefing schedule on the matter.

U.S. District Judge Henry Autrey in St. Louis ruled on Thursday that while the six Republican-led states had raised "important and significant challenges to the debt relief plan," he threw out their lawsuit on grounds they lacked the necessary legal standing to pursue the case.

Nebraska, Missouri, Arkansas, Iowa, Kansas and South Carolina said Biden's plan skirted congressional authority and threatened the states' future tax revenues and money earned by state entities that invest in or service the student loans.

The non-partisan Congressional Budget Office in September calculated the debt forgiveness would cost the government about $400 billion.

White House press secretary Karine Jean-Pierre said Thursday's temporary order does not prevent borrowers from applying for student debt relief or bar the Biden administration from reviewing applications and preparing them for transmission to loan servicers.

"We encourage eligible borrowers to join the nearly 22 million Americans whose information the Department of Education already has," Jean-Pierre said.

"It is important to note that the order does not reverse the trial court's dismissal of the case or suggest that the case has merit," she added. "It merely prevents debt from being discharged until the (appeals) court makes a decision."

Nebraska Attorney General Doug Peterson, a Republican who is leading the lawsuit, welcomed the temporary stay.

"It’s very important that the legal issues involving presidential power be analyzed by the court before transferring over $400 billion in debt to American taxpayers,” he said.

The case reaching the 8th Circuit is one of a number that conservative state attorneys general and legal groups have filed seeking to halt the debt forgiveness plan announced in August by Biden, a Democrat.

Autrey ruled about an hour after U.S. Supreme Court Justice Amy Coney Barrett denied without explanation an emergency request to put the debt relief plan on hold in a separate challenge brought by the Wisconsin-based Brown County Taxpayers Association.

Biden said the U.S. government will forgive up to $10,000 in student loan debt for borrowers making less than $125,000 a year, or $250,000 for married couples. Borrowers who received Pell Grants to benefit lower-income college students will have up to $20,000 of their debt canceled.

The policy fulfilled a promise that Biden made during the 2020 presidential campaign to help debt-saddled former college students.

Democrats are hoping the policy will boost support for them in the Nov. 8 midterm elections in which control of Congress is at stake.

I'm a fan of this move though it will definitely get any remaining college grads that lean right to flip.

Dems are wasting their time appealing to young people by legalizing weed or dropping charges or eliminating debt. It's the 30 plus or 40 plus voter that moves the needle in Elections. This Off the Court fool thinks the weed and student debt thing is a winning plan for Dems, but what's killing Dems right now is rising inflation and rising crime in Blue cities all across the nation. Even though I still agree with some democrat views, what has transpired in the last few years has completely turned me off about them. I remember when Democrats were the party of "free speech" and they were all about "my body, my choice", but what has transpired since 2020 is the reason why I won't vote democrat anytime soon.

- They are for censorship, can't say anything they don't agree with, even if it ends up being true like Hunter's laptop.

- They got COVID completely wrong, FORCING people to get shots even if young healthy people didn't want it. And now Big Pharma admits the vaccine wasn't tested to stop the spread of Covid. SMH

- Joe Biden basically being Jimmy Carter 2.0

I actually didn't mind Obama, thought he was decent, but I did notice the party was shifting to another direction while he was in office and now in 2022 they have become something I don't recognize.

What we are seeing is a political realignment, which also happened in the 1960's.

If you have your own office youre probably more likely to be conservative.

The “democrats have more college graduates” thing is mainly due to professions like school teachers, nurses, government workers, and other female dominated occupations, since females are more likely than males to be democrats.

Important jobs obviously, but not sure how many of them have a private office with their degrees on the wall. Maybe a cubicle at the DMV I suppose.

That said, I dont concern myself with left or right much these days. Politicians wont do what the people want anyway so theres no sense arguing about it.

genuine question. why isn't public college free? k-12 is free (nothing is actually 'free', i understand), but why the cut-off there? as i understand it, general public college classes are offered for free, but if you want to branch off into anything particular, that's no longer the case. explain it like i'm five because i have a 10th grade education... or rather, i have no experience in the educational system beyond high school.

what's the argument against it?

The typical white collar setting is pretty diverse at this point from top to bottom. It isn't conservatives forcing everyone to undergo diversity training. But the sector is most telling. If it's a tech company it's going to be liberal offices from top to bottom. If it's the headquarters of Smith & Wesson then yeah.

Overall college is trending left. Even in this thread it's all the right leaning posters rooting against college grads. I know that there are still college grads that lean right, and the red states working hard to deny them relief isn't going to sit well.

That's probably why the block is temporary. They know it's an unpopular stance. The only ones cheering for it are right leaning people without degrees.

Your mortgage doesn't do anything for the country. Your education does.

If you believe in college enough to have 3 degrees you would not only understand that but you'd be cheering on free education. I think you have no degrees.

Acquiring a trade does most for this country, not some piece of paper under glass. A lot of degrees are meaningless.

I have a Masters in Business Aministration, and although I dont regret getting it, from a strategic point of view it was largely a waste of time.

And that's a practical degree. A lot of the degrees that these goldbricking knuckleheads want a refund on their loans for aren't worth the paper they're printed on.

If the right is trending away from college education that will not end well. It already isn't. Those technical plumbing degrees can make someone a good salary sure. But that's the ceiling.

You are wrong here. The ceiling for a plumber and attorney are similar because neither one is approaching that 500k income without owning their own business. It isn't about the degree. It is about effort and having a plan.
