Yes, it is legal. Thanks to the US constitution, specifically the 1st amendment, he is allowed to film/photograph in public and post it wherever he wants. There is no right to privacy in public. I know people think you need someone’s consent to film them in public, but that’s unequivocally false. You can film anything you can see whilst standing on public property, including govt buildings

so if its not hidden, the law simpy expects the person/object to go away if it doest want to be filmed?

I think thats about using an individual’s image for commercial purposes. You cant focus the camera on a person and then profit from them without their consent.

If youre filming a building or an event etc and people happen to pass by the camera, thats fine. Or, like in this case, youre not posting the kid’s image for commercial purposes but as public info regarding a crime, thats also fine.

https://en.m.wikipedia.org/wiki/Fair_use

If it’s for education purposes it is generally permissible, which this would be. He is educating the public about a criminal who has not been apprehended.

If he has the wrong kid’s pic then he’d be in trouble. But assuming it’s the right guy youre certainly allowed to post a pic of someone who committed a hit and run against you.

This would he considered news reporting. And a person by default holds copyright over their own image. PG could use the kid’s image to report a crime in progress.

A photograph is an artistic work.

And just practically speaking, if you were taking pictures outside, and someone ran up and whacked you with a crowbar and ran off with your wallet, and your phone snapped a pic of them… you dont think you could show it to people to help capture the person??

Of course you could.

i dont know. im pretty sure the kid did this.

but who can prove it? can you just plaster photographs of pp onine saying they did this and that?

as far as the artistic work im getting conficting resuts.

"The definition of artistic works is given in the CDPA as: • graphic works such as paintings, drawings, diagrams, maps, charts and plans, engravings, lithographs, etchings or woodcuts, sculpture, collage; this includes the surface design of manufactured products such as pottery and textiles."

if you were to prove the legalness of that pic, what actua paragraph or sentence woud you citate?

im sure since its a crimina offense, its prob okay and theres some paragraph/sentence which makes that clear.
