Need Advice: Breaking Up With Roommate Today
 
Been living with this woman since November.

I paid 1st and last, and committed until Nov. 2013.

Nice place, close enough to work, reasonable rent.


But I'm telling her today that I'm giving her 90 days notice.

I work nights, and can't get enough, consistent sleep when I'm there.

Plus she's annoying and a pain in the a$s.


She pretty much knows it's coming. She's going to resist, since I committed to a year.


I need some advice on what to say when we speak tonight.

Anyone done this before??

do you have a written contract with her for the 1 year, if so i wouldnt go through with it since she could sue you for the living cost she will accrue for the remainder of that 1 year.

if no contract is involved than you can kick her out whenever youd like to. Id just tell her what problems your having with her as a roommate and tell he she has to leave. I also would look up the local laws on evicting someone not on a contract. there could be a legal process, or it could just be "ill call the cops and have you escorted out"

He's the one leaving.

I think 90 days notice is sufficient

it's not what you think or feel is fair. the law doesn't care how you feel or think.

the only thing matter is what the contract says.

what state do you live in?

in california, there's a rule book (actually it's available in PDF file) that's 80 pages long of boring yet important rules; it states all the tenant/landlord rights and rental contracts and all issues pertaining to common disputes that regularly end up in court.

you should google up your state and "rental guidelines" or similar words in your key search. if such a book exists in your state, you obviously don't need to read the entire thing, but there should be sections on evictions.

but if you never had a contract signed, then you don't need to worry much about the law since you never had a legal binding contract, but know all your rights first. every state might have their own set of laws related to this. find steps on things that she might had violated which give you your right to terminate the contract, if there's any.

bottom line: it dont matter what you think it's just or fair. if you end up in court, then the contract, fine prints, guidelines, and laws matter first if they're written. a contract is a contract. the law doesn't care if you later discover that you simply find the other party to be annoying.

Are both of your names on the lease? Without answering this question, help can't go much further.

Unless it's completely unbearable I'd say live it out till the end of the year and make the best of it, otherwise be upright with her and tell her why you need to get out of there.

there is a contract/document, drawn up by her.

it's very vague, and doesn't say anything about penalties for early termination or even how much notice she requires.

it does, however, say that the rental commitment can not be broken before Nov. '13.

i live in Ontario, and most legislation I've read says that the contract must be honoured. Or, it states, I can either:

a) find someone to replace me

b) negotiate an early exit

yeah, that's what my GF suggests I do if the talk doesnt go well:D .

personally, I'm planning/hoping to just try to talk my way out of it.
