Yep, the rules of deposition are much more lenient. There was no judge present, usually just a Steno one of two parties parties involved and the attorneys for both sides. It's a chance for opposing counsel to have some time for discovery. He probably just lost his own case for himself with his demeanor and everything he said in there can be used in the trial
