If she attacked him first, I would be all for him hitting her back. But he spat on her twice, which is the ultimate disrespect to me, and then hit her twice hard in the head without her landing a single blow on him. The way he hit her and the way she hit the rail and then the floor, could actually have killed her. Luckily she wasn't killed or paralysed.

i worked in a court that did that. If they subpoenaed a woman to appear a trial to testify against her abuser for a DV case and she didn't show, they'd send cops out to pick her up, and give her one last chance to testify or they would charge them with obstruction or falsification.

usually in the situations like that the prosecutor should and usually will ask:

" Do you want to be here? "

" Isn't it true i am forcing you to be here?"

"If you had a choice, isn't it true you would NOT testify against so and so?"
