If that was a foul there were a lot of no calls on fouls in that game. That would be a really soft foul call.

better question is why was that charge called on battier, instead of a 6th foul on durant?

Maybe because it wasn't a charge? They showed that replay more times than a Mike Tyson knockout and you could clearly see Battier trying to slide under Durant after he was already in the air.
