One irked Twitter user quipped that "Instagram is now the new iStockPhoto, except they won't have to pay you anything to use your images."

"It's asking people to agree to unspecified future commercial use of their photos," says Kurt Opsahl, a senior staff attorney at the Electronic Frontier Foundation. "That makes it challenging for someone to give informed consent to that deal."

That means that a hotel in Hawaii, for instance, could write a check to Facebook to license photos taken at its resort and use them on its Web site, in TV ads, in glossy brochures, and so on -- without paying any money to the Instagram user who took the photo. The language would include not only photos of picturesque sunsets on Waikiki, but also images of young children frolicking on the beach, a result that parents might not expect, and which could trigger state privacy laws.

Facebook did not respond to repeated queries from CNET this afternoon. We'll update the article if we receive a response.

Sure glad I don't use Instagram or Twitter. Pretty sure I'm ditching the Facebook profile, as well.

Should be noted Instagram's TOS agreement is basically the same as Facebook's. Instagram just came out and admitted it.

Well i'm sure a lotta people can at least rest easy knowing they probably won't have a lot of bidders lining up to buy bathroom mirror pictures of 170 pound girls in stretch pants making duck faces...

This is an incredibly ballsy business move. They are counting on losing millions and millions of users, but believe that enough people won't opt out by their deadline that they'll end up with one of the greatest stock photo collections in existence.

I dont have an instagram but my girl uses this thing nonstop and has so many pics of me up on there. never cared because i THOUGHT it was private...until now

This comes as no surprise since I found out Instagram is owned by Facebook. Facebook has been doing this for a long time. Any photos you post on Facebook is their property. This was a known thing years ago and after I found out, I deactivated my profile.

I wish and hope everyone will delete their Instagram and Facebook. I know a lot of people use Facebook and if you do, don't post pictures on their site.

I guess it comes with a price if you are a FB user.

You want to brag with pictures? You want to be famous? FB celebrity? Well, they just going to own your picture.

I love how they have all these questions you can fill out on your profile, the more they know about you the more they can sell to advertising companies and have them flood your emails.

A lot of photographers use instagram as an artistic outlet and this opens up the possibility of FB essentially stealing their art and selling it. And of course there is the internet privacy issues. Damn, people were wondering what revenue streams that FB could generate and I guess we just found one of them.

Facebook is the biggest marketing/ad campaign in the world. They are essentially what telemarketers use to do when they call your home and have you do a survey.

Facebook strategically implemented profiling on their website. The more questions you answer the more they know about you. Luckily for me, they only know that I am a MALE.

Let's think about it for one second, they know what books, movies, stores, authors and things you like. They also know where you go and where you check yourself in. Who your friends are and what businesses is on your friends list.

By knowing all this, if I was FB, I would sell your information such as the ones mentioned above with your email address as well, to companies. They blast you with spam and perhaps phone calls or text to you.

You like Harry Potter? No problem, they will contact you. What restaurants you like, no problem, I have sold your likes to restaurant.com and they turnaround and make contact that restaurant, that customers exist. They text you with coupons.

You like basketball? Great!...ISH is going to get that list of clients and off they go to get you to join. Things of that nature.

Facebook photos are already under the same t&c's so regular people who just have pics of themselves on facebook have no reason to panic over this (as they are already having their images used not sure if you can opt out on facebook though). There's lots of blogs around of people seeing themselves/friends photos used for dating ads and the like. This mainly is a big kick in the balls to photographers and creatives.

This is pretty shady, I've got instagram, but I rarely upload pics, I doubt there are any of my pics that would ever get used, but I know a lot of girls who put up modelling pics of themselves, imagine if a strip club bought one of their pics and used them on a billboard or a flyer... This is pretty f*cked.

Every hashtag people have used on pics makes it incredibly easy for advertisers to track down the sort of pics they want. This all of a sudden makes sense. I'm not going to be uploading any more pics, that's for sure.
