I believe the cop was probably mouthing off. As a cop you should know better to not get into confrontation with people. If it is serious, then show your badge and the suspect will leave you alone.

News outlets reporting that he was an off-duty officer is simply them relaying an identifying feature of the victim. It's just info about him.
