Default My friend paid for a PS3 on ebay and...

it turned out to be a hoax. The seller didn't give him any PS3, and now the $350 my friend paid cannot be retrieved. The seller's account has been suspended, and now my friend can't get his $350 back. Weird, I thought Ebay would have a better policy than that, I thought you could get your money back for something like that.

If the seller wrote in small font that there was no item to bid on then would he get away with it? I remember reading somewhere (not sure where) that some guy tried this an it worked because the bidder never read the small font. Don't know if it's true though.

if it were truly a scam, Ebay has the insurance policy for them to take the loss and refund your money...

so therefore, it must have been small type on the seller's part saying that they really werent gona sell it to you.

for instance, someone once sold a PSP BOX for $400.

he put in fairly large print that he was just selling a box. some idiot actually paid $400 for it

Thats a scam. Did anyone see that Judge judy case where someone sued b/c they received pictures and a box instead of an actual cellphone even though the auction said there was no cellphone. She won too.

I assume you pay with paypal. Even though it sucks, you need to submit a claim and escalate it. Was the seller verified? I forgot, but theres a way to see if their address is verified I think.

I saw an episode where a guy got sued for leaving bad feedback. He bid on some dolls(what a ***) and decided not to pay for them, but instead leave feedback that the seller sent him porn instead. Seller won easily.

Always review the seller's feedback. Anything less than 95% positive rating should be a questionable decision to purchase from them.

I would never buy from someone unless they've sold 100+ items with 95% or higher positive rating.

Yea, you should escalate through Paypal to a claim. They have buyer protection and it should be an easy case to win since if he didn't send anything, when it asks him to provide tracking info he won't have any, they'll rule in your favor instantly.

If he paid via credit card, he can also try to go through Visa or whoever to get his money

45 and above is enough. I got scammed by a guy who sold 25000 some items. He was good for a while then just kept listing his crap and scamming people... it was only 12 bucks tho so I didn't even try to get it back.

To me, it would be more about the principle of the whole thing. People that scam others (like some f@ggot who tapped into my credit card information) should be choked to death.

Anyone got Spreewell's number?

How can ANYONE living in modern times not know this? EBay is so huge, it's part of everyday life, almost like going to the grocery store.

PayPal will almost always back up the buyer, the burden of proof is actually on the seller. Sellers hate PayPal. Use a credit card and that's even better when it comes to a dispute. The burden of proof then falls on PayPal, who transfers it to the seller. PayPal hates CC companies. Always use PayPal, funded by a credit card if possible. If you send out a money order, you might as well kiss your $ goodbye.

You cannot completely avoid having problems with buying stuff online, but with a little common sense there is very few reasons scammers should be able to scam you AND get away with it these days. Getting hacked, now that's a whole "nother" story.
